INFORMATION:

Districts are encouraged to adopt Board resolutions commending School Counselors and publicize the role of School Counselors in the educational process.  School Counselors continue to reduce barriers to learning and provide the support necessary for all students to achieve at the highest level possible. It is appropriate that the Board of Education recognize and express their appreciation for School Counselors for the hard work and dedication of these individuals for students, schools, and the community.  This resolution should be shared with each school and work site to honor School Counselors for the tremendous impact they can have in helping students achieve school success. 

 

The theme for this year's National School Counseling Week is "School Counseling: Standards-Based, Student-Focused".

February 10, 2024, will usher in the Lunar New Year for 2024 - the Year of the Dragon. The Lunar New Year is of special significance and represents a major celebration for Chinese and many other Asian people throughout the world, including families with roots in countries that include China, Vietnam, South Korea, and Singapore. The Lunar New Year represents a number of important traditional, social, and cultural events and values, many of which have become customary to observe in the United States.

 

Conejo Valley Unified School District is committed to honoring and valuing the traditions and cultural significance of the Lunar New Year and the contributions and accomplishments of the Asian and Pacific Islander communities.

Should the Board of Education accept the Building Fund (Measure I) Financial and Performance Audits for 2022-2023?

 

INFORMATION:

 

The Building Fund (Measure I) Financial and Performance Audit for 2022-2023 was conducted by independent auditors in accordance with the standards contained in Government Auditing Standards, issued by the Comptroller General of the United States. The independent auditor's findings and conclusions are stated in the audits.

 

The Auditor's opinion: "In our opinion, the financial statements referred to above present fairly, in all materials respects, the financial position of the Building Fund (Measure I) of Conejo Valley Unified School District as of June 30, 2023, and the changes in financial position for the fiscal year then ended in accordance with accounting principles generally accepted in the United States of America."

 

The Auditor's opinion regarding the performance audit: "The results of our tests indicated that the District expended Building Fund (Measure I) funds only for the specific projects approved by the voters, in accordance with Proposition 39 and outlined in Article XIIIA, Section 1(b)(3)(C) of the California Constitution."

 

The Independent Citizens' Bond Oversight Committee received the audit at their public meeting on December 20, 2023.

CVUSD receives updates to Board Policies and Administrative Regulations from GAMUT. GAMUT is a policy update service offered through the California School Boards Association (CSBA) which provides information about new laws and court opinions which may affect Board Policies, Administrative Regulations, and Board Bylaws.

 

This bylaw is updated to revise the first philosophical paragraph to recognize the need to provide legal representation to the district and the importance of cost-effective legal advice and services, clarify that the Governing Board may appoint and fix and order paid legal counsel's compensation, expand the types of entities that the Board may contract with to serve as legal counsel, and reflect that the Board supports pursuing collaborative legal efforts with other districts as well as other government agencies as appropriate. This bylaw is also updated to clarify that districts may, but are not required, to initiate a Request for Proposals to advertise and solicit proposals for legal services, and that districts may consider the attorney's, firm's, and/or entity's relevant legal reputation when evaluating such attorneys, firms, and/or entities. Additionally, this bylaw is updated to reflect that any attorney representing the district is required to be admitted to practice law in California.

 

The attached version includes verbiage updates, referenced in bold/blue/italics, that were requested by the Board of Education at the 12/13/23 Board meeting.

The updates also include expanded language on the assignment of teachers to departmentalized classes outside their credential authorization, assignment of teachers to elective courses outside their credential authorization, and assignment to special schedules.

Board Policy 1230 requires annual Board approval for parent support/booster organizations desiring to raise money to benefit the students of any school or program. The policy requires applicants to provide specific information including, but not limited to, current financial documents. It is expected that booster organizations comply with the California Education Code prohibiting pupil fees for participation in educational activities, which includes extra-curricular activities. These booster clubs have submitted the required information to the Superintendent’s designee for consideration of the Board.

ISSUE:

 

Should the Board of Education preauthorize overnight trips for high school winter co-curricular teams that may advance to the California Interscholastic Federation (CIF) playoffs or state competition?

 

INFORMATION:

 

The high school winter co-curricular teams request permission for an overnight trip in the event that the teams qualify for a CIF playoff or state competition that requires an overnight stay due to distance. Pre-authorization is requested only because it cannot be determined in advance whether a team will require such permission until the outcome of the final local competitions.  The following winter activities may be involved: boys/girls basketball, boys/girls soccer, boys/girls water polo, and wrestling.

 

For athletic events, CIF will reimburse schools a small stipend for food and travel (with prior approval) and in some instances (depending on distance from home) for lodging. The remainder of the costs will be paid through Booster Club and Athletic funds.  In accordance with Board Policy 6153, no student will be required to fundraise or make payments. There will be no cost to the District.

INFORMATION:

 

CVUSD receives updates to Board Policies and Administrative Regulations from GAMUT. GAMUT is a policy update service offered through the California School Boards Association (CSBA) which provides information about new laws and court opinions which may affect Board Policies, Administrative Regulations, and Board Bylaws.

 

This Board Policy is updated to reflect new law (AB 1078, 2023) which (1) requires that the district's policy prohibiting discrimination, harassment, intimidation, and bullying include a statement that the policy applies to all acts of the Governing Board and Superintendent in enacting policies and procedures that govern the district, (2) clarifies when it is unlawful discrimination for the Board to refuse to approve the use or prohibit the use of any textbook, instructional material, supplemental instructional material, or other curriculum for classroom instruction, or any book or resource in a school library, (3) requires the California Department of Education to develop, by July 1, 2025, guidance and public educational materials to ensure that all Californians can access information about educational laws and policies that safeguard the right to an accurate and inclusive curriculum, and (4) provides that complaints alleging discrimination related to the use or prohibited use of any textbook, instructional material, supplemental instructional material, or other curriculum for classroom instruction, or any book or resource in a school library may be brought under the district's uniform complaint procedures or may be directly filed with the Superintendent of Public Instruction, as specified. This policy is also updated to reference new U.S. Department of Education Office Of Civil Rights Guidance documents which provide that (1) a district may not separate students based on race, but may include group discussions or activities that focus on race as part of the curriculum, courses, or programs so long as access or participation is not permitted or limited based on race, (2) a school-sponsored program with emphasis on race, such as a student club, that is open to all students, typically would not violate Title VI solely because of its race-related theme, and (3) a district's responsibility not to discriminate against students applies to any of its programs or activities, whether directly or through contractual or other arrangements. Additionally, this policy is updated to expand the list of characteristics for which discrimination is prohibited in order to more closely align with law; and, to reflect new law (SB 523, 2022) which includes reproductive health decision-making as a characteristic for which employees, job applicants, unpaid interns and volunteers are protected against unlawful discrimination and harassment.

INFORMATION:

 

CVUSD receives updates to Board Policies and Administrative Regulations from GAMUT. GAMUT is a policy update service offered through the California School Boards Association (CSBA) which provides information about new laws and court opinions which may affect Board Policies, Administrative Regulations, and Board Bylaws.
 

This Board Policy is updated to reflect new law (AB 1078, 2023) which (1) requires the California Department of Education (CDE) to develop, by July 1, 2025, guidance and public educational materials to ensure that all Californians can access information about educational laws and policies that safeguard the right to an accurate and inclusive curriculum, (2) clarifies when it is unlawful discrimination for the Governing Board to refuse to approve the use or prohibit the use of any textbook, instructional material, supplemental instructional material, or other curriculum for classroom instruction, or any book or resource in a school library, (3) provides that complaints alleging discrimination related to the use or prohibited use of any textbook, instructional material, supplemental instructional material, or other curriculum for classroom instruction, or any book or resource in a school library may be brought under the district's uniform complaint procedures or may be directly filed with the Superintendent of Public Instruction, as specified, and (4) requires CDE to issue, by July 1, 2025, guidance regarding how to review instructional materials to ensure that they represent diverse perspectives and are culturally relevant. This policy is also updated to expand and amend the list of criteria to be considered when instructional or library materials are being challenged; and, to provide that, unless required by law, any challenged material that is reviewed by the district will not be subject to further reconsideration for 12 months.

 

This Administrative Regulation is updated to provide that for an instructional materials complaint for a nonprinted material the location of the objection be given; include that acknowledgement of receipt of an instructional materials complaint and notification of a review committee's decision be in writing; and, add that staff, in addition to the Superintendent or designee and teacher(s), be notified by the Principal as appropriate when an instructional materials complaint is received. This regulation is also updated to delete material in the section "Formal Complaint" related to a request by a parent/guardian who has filed a complaint for the student to be excused from using the challenged material while the complaint is pending, and, move the section "Review Committee" to come before the section "Superintendent Determination" so that it follows chronologically. Additionally, this regulation is updated to amend the section "Review Committee" to provide that (1) the Superintendent or designee may appoint parents/guardians and students, in addition to administrators and staff from relevant instructional and administrative areas, to serve on the committee, (2) include that the Superintendent or designee may provide training to the review committee to ensure the committee is informed regarding its responsibilities, applicable laws, and Board policies and administrative regulations when reviewing instructional materials, and (3) delete the list of criteria to be considered when instructional materials are being challenged, as this list is provided in the accompanying Board policy.

INFORMATION:

 

Since November 1988, state law has required that schools receiving state funding to prepare and distribute a School Accountability Report Card (SARC). A similar requirement is also contained in the federal Elementary and Secondary Education Act (ESEA). As required by state law, the draft SARC documents were prepared and published on the CVUSD website at https://www.conejousd.org/SARC-SPSA on or before February 1, 2024.


The purpose of the report card is to provide parents and the community with important information about each school. A SARC can be an effective way for a school to report on its progress toward achieving goals. The public may also use a SARC to evaluate and compare schools on a variety of indicators, including demographic data, school safety and climate for learning information, academic data, school completion rates, class sizes, teacher and staff information, curriculum and instruction descriptions, postsecondary preparation information, and fiscal and expenditure data.


BP0510 requires the Board of Education to approve the draft SARC documents and CVUSD to notify parents and the community of the availability of the report cards, which can be obtained both online or as a hard copy upon request.

The District Workers' Compensation insurance plan is a self-insured plan run by the District. When losses occur, the District's third-party administrator handles the claims. Cases are reviewed, assessed, and brought forward for settlement based on the recommendation of our Director of Safety and Risk Management, our third-party administrator, and (when applicable) the attorney representing the District.

 

As per Board Policy 3320 and in accordance with Government Code 935.4, the Board delegates to the Superintendent the authority to allow compromise or settle claims of $50,000 or less pursuant to any conditions of coverage in the District's JPA agreement or insurance coverage. INFORMATION:

 

CVUSD receives updates to Board Policies and Administrative Regulations from GAMUT. GAMUT is a policy update service offered through the California School Boards Association (CSBA) which provides information about new laws and court opinions which may affect Board Policies, Administrative Regulations, and Board Bylaws.

 

Board Policy 3230 is updated to reflect new federal regulations (85 Fed. Reg. 49506), effective November 12, 2020, which clarify and renumber requirements for the use and accounting of federal grant funds pursuant to the Office of Management and Budget's Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards (commonly called the "Uniform Guidance"). This policy also reflects an amendment to the Uniform Guidance which extends the timeframe for submitting the final performance report from 90 to 120 calendar days after the ending date of the grant.

 

Administrative Regulation 3230 is updated to reflect new federal regulations (85 Fed. Reg. 49506), effective November 12, 2020, which clarify and renumber requirements for the use and accounting of federal grant funds pursuant to the Uniform Guidance. This regulation also reflects amendments to the Uniform Guidance which (1) extend the timeframe for paying all obligations of federal funds from 90 to 120 calendar days after the end of the funding period; (2) require districts to give a preference to the purchase, acquisition, or use of goods, products, or materials from the United States as practicable; and (3) increase the threshold for "micro-purchases" and "small purchases" that qualify for simplified procurement procedures. The regulation also adds the requirement to provide for disciplinary actions to be applied when officers, employees, or representatives of the district violate conflict of interest standards. The section on "Personnel" is revised to (1) add the district's responsibility to check employee records and ensure that the charges are accurate, allowable, and properly allocated and (2) clarify the documentation requirements for employees whose salary is paid with state or local funds but is used to meet a cost-sharing or matching requirement of the federal grant.

INFORMATION:

 

The Conejo Valley Unified School District (CVUSD) implements the selection and adoption of instructional materials, specifically for grades 6-8, in accordance with Board Policy and Administrative Regulation 6161.1. CVUSD considers the California Department of Education’s Recommended Literature List. However, the California Department of Education notes, “The Recommended Literature List is intended as a tool to assist districts as they select literature, but the list only recommends titles. Ultimately, it is the responsibility of the District to select literature according to the selection policies that are in place.”

INFORMATION:

 

The Conejo Valley Unified School District (CVUSD) implements the selection and adoption of instructional materials, specifically for grades 9-12, in accordance with Board Policy and Administrative Regulation 6161.1. CVUSD considers the California Department of Education’s Recommended Literature List. However, the California Department of Education notes, “The Recommended Literature List is intended as a tool to assist districts as they select literature, but the list only recommends titles. Ultimately, it is the responsibility of the District to select literature according to the selection policies that are in place.”

CVUSD receives updates to Board Policies and Administrative Regulations from GAMUT. GAMUT is a policy update service offered through the California School Boards Association (CSBA) which provides information about new laws and court opinions which may affect Board Policies, Administrative Regulations, and Board Bylaws.

 

Board Policy 1340 has been updated to reflect new law (AB1819, 2019) which allows members of the public to use their own equipment on district premises, free of charge, to photograph, copy, or reproduce a disclosable district record provided that the equipment does not make physical contact with the record. 

 

Administrative Regulation 1340 updates the list of confidential public records to include the prohibition against releasing an employee's personal email address, upon request from the employee. This regulation also reflects new law (AB 1819, 2019) which allows members of the public to use their own equipment, free of charge, to photograph, copy, or reproduce a disclosable district record on district premises, provided that the means of copying or reproducing the record does not does not damage the record and does not result in unauthorized access to the district's computer systems or secured networks.

Amendments to Board Policy 1312.3 reflect new law (AB 1078, 2023) which (1) clarifies when it is unlawful discrimination for the Governing Board to refuse to approve the use or prohibit the use of any textbook, instructional material, supplemental instructional material, or other curriculum for classroom instruction, or any book or resource in a school library, (2) provides that complaints alleging discrimination related to the use or prohibited use of any textbook, instructional material, supplemental instructional material, or other curriculum for classroom instruction, or any book or resource in a school library may be brought under the district's uniform complaint procedures or may be directly filed with the Superintendent of Public Instruction, as specified, and (3) requires CDE to develop, by July 1, 2025, guidance and public educational materials to ensure that all Californians can access information about educational laws and policies that safeguard the right to an accurate and inclusive curriculum. The policy is also updated to reflect that the California Department of Fair Employment and Housing is now called the California Civil Rights Department.

GAMUT is a policy update service offered through California School Boards Association (CSBA), which provides information about new laws court opinions which may affect Board Policies, Administrative Regulations and Board Bylaws. Amendments to Administrative Regulation 1312.4 reflect new law (AB 1078, 2023) which (1) requires the California Department of Education (CDE) to develop, by July 1, 2025, guidance and public educational materials to ensure that all Californians can access information about educational laws and policies that safeguard the right to an accurate and inclusive curriculum, (2) provides that complaints related to instructional materials alleging that more than one student does not have sufficient textbooks or instructional materials as the result of an act by the Governing Board, or the Board's failure to remedy the deficiency, may be filed with the Superintendent of Public Instruction (SPI) directly, and the SPI may directly intervene without waiting for an investigation, and, (3) requires CDE, upon a finding that a district has not provided sufficient textbooks or instructional materials, to take all remedial actions required by law, including purchasing textbooks and instructional materials and assessing a financial penalty against the district's local control funding formula. The regulation is also updated to reflect new law (SB 114, 2023) which requires that the Williams uniform complaint procedure be used to address a complaint related to a teacher misassignment that claims that a teacher who lacks credentials or training to teach English learners is assigned to teach a class with one or more English learners in the class, (formerly with more than 20 percent English learners in the class), and new law (SB 760, 2023) which authorizes districts to temporarily close a restroom for a documented student safety concern, an immediate threat to student safety, or to repair the facility.
