ISSUE:

BACKGROUND:
Upon the Board's annual reorganizational meeting, their advisory committees are reviewed and any requests for changes in assignments are discussed. The attached Board Advisory Committees list has been updated to reflect the Board's discussion on it during their meeting on December 13, 2023.

This review and approval is procedural.

ISSUE:
Should the Board of Education adopt a resolution declaring February 5-9, 2024, as "National School Counseling Week"?
INFORMATION:
Districts are encouraged to adopt Board resolutions commending School Counselors and publicize the role of School Counselors in the educational process. School Counselors continue to reduce barriers to learning and provide the support necessary for all students to achieve at the highest level possible. It is appropriate that the Board of Education recognize and express their appreciation for School Counselors for the hard work and dedication of these individuals for students, schools, and the community. This resolution should be shared with each school and work site to honor School Counselors for the tremendous impact they can have in helping students achieve school success.
The theme for this year's National School Counseling Week is "School Counseling: Standards-Based, Student-Focused".

ISSUE:
Should the Board of Education adopt a resolution declaring February 10, 2024, as the start of the Chinese Lunar New Year?
INFORMATION:
February 10, 2024, will usher in the Lunar New Year for 2024 - the Year of the Dragon. The Lunar New Year is of special significance and represents a major celebration for Chinese and many other Asian people throughout the world, including families with roots in countries that include China, Vietnam, South Korea, and Singapore. The Lunar New Year represents a number of important traditional, social, and cultural events and values, many of which have become customary to observe in the United States.
Conejo Valley Unified School District is committed to honoring and valuing the traditions and cultural significance of the Lunar New Year and the contributions and accomplishments of the Asian and Pacific Islander communities.

ISSUE:
Should the Board of Education accept the Building Fund (Measure I) Financial and Performance Audits for 2022-2023?
INFORMATION:
The Building Fund (Measure I) Financial and Performance Audit for 2022-2023 was conducted by independent auditors in accordance with the standards contained in Government Auditing Standards, issued by the Comptroller General of the United States. The independent auditor's findings and conclusions are stated in the audits.
The Auditor's opinion: "In our opinion, the financial statements referred to above present fairly, in all materials respects, the financial position of the Building Fund (Measure I) of Conejo Valley Unified School District as of June 30, 2023, and the changes in financial position for the fiscal year then ended in accordance with accounting principles generally accepted in the United States of America."
The Auditor's opinion regarding the performance audit: "The results of our tests indicated that the District expended Building Fund (Measure I) funds only for the specific projects approved by the voters, in accordance with Proposition 39 and outlined in Article XIIIA, Section 1(b)(3)(C) of the California Constitution."
The Independent Citizens' Bond Oversight Committee received the audit at their public meeting on December 20, 2023.

Should the Board of Education approve the amendments to Board Bylaw 9124 - Attorney?
INFORMATION:
CVUSD receives updates to Board Policies and Administrative Regulations from GAMUT. GAMUT is a policy update service offered through the California School Boards Association (CSBA) which provides information about new laws and court opinions which may affect Board Policies, Administrative Regulations, and Board Bylaws.
This bylaw is updated to revise the first philosophical paragraph to recognize the need to provide legal representation to the district and the importance of cost-effective legal advice and services, clarify that the Governing Board may appoint and fix and order paid legal counsel's compensation, expand the types of entities that the Board may contract with to serve as legal counsel, and reflect that the Board supports pursuing collaborative legal efforts with other districts as well as other government agencies as appropriate. This bylaw is also updated to clarify that districts may, but are not required, to initiate a Request for Proposals to advertise and solicit proposals for legal services, and that districts may consider the attorney's, firm's, and/or entity's relevant legal reputation when evaluating such attorneys, firms, and/or entities. Additionally, this bylaw is updated to reflect that any attorney representing the district is required to be admitted to practice law in California.
The attached version includes verbiage updates, referenced in bold/blue/italics, that were requested by the Board of Education at the 12/13/23 Board meeting.

ISSUE:
Should the Board of Education approve the amendments to Board Policy and Administrative Regulation 4113 - Assignment?
INFORMATION:
The Board Policy was updated to remove obsolete language from the No Child Left Behind Act and add language concerning misassignments per Education Code 44258.9. It also includes language on the equitable distribution of qualified and experienced teachers.
The Administrative Regulation updates include the removal of obsolete language based on the No Child Left Behind Act. The updates also include expanded language on the assignment of teachers to departmentalized classes outside their credential authorization, assignment of teachers to elective courses outside their credential authorization, and assignment to special schedules.

ISSUE:
Should the Board of Education approve the contracts under $5,000 listed below?
INFORMATION:
Education Code 17604 states "wherever in this code the power to contract is invested in the governing board of the school district or any member thereof, the power may by a majority vote of the board be delegated to its district superintendent, or to any persons that he or she may designate, or if there be no district superintendent then to any other officer or employee of the district that the board may designate. The delegation of power may be limited as to time, money or subject matter or may be a blanket authorization in advance of its exercise, all as the governing board may direct. However, no contract made pursuant to the delegation and authorization shall be valid or constitute an enforceable obligation against the district unless and until the same shall have been approved or ratified by the governing board, the approval or ratification to be evidenced by a motion of the board duly passed and adopted." Therefore, all contracts are presented to the Board of Education for approval. Contracts over $5,000 will be presented individually as a separate Board agenda item.
